EXCLUSIVE ‘BREAKING NEWS’: Why Were Key Parts of Kelly Reichert’s Testimony to the RCMP Missing? Why Was Only SOME of Erik Bornmann’s Testimony Accepted by the RCMP?

Let’s do this piecemeal and then reassemble it for you.

In 2007-2008 when the defence was winning applications, hand over fist, before Madam Justice Elizabeth Bennett, they discovered a ‘Do Not Disclose’ document that mysteriously appeared after not having been disclosed previously by the RCMP or the Office of Special Prosecutor Bill Berardino.

It was authored by an investigator who was present when former BC Liberal Party Executive Director Kelly Reichert was being interviewed by the RCMP. Remember, Mr. Reichert was, and remains, the brother-in-law of the RCMP investigation team’s Captain, then Sgt. Kevin DeBruykere–know a senior Inspector. It was he who led ‘Operation Everywhichway’.

In the document, it was noted that, at one point, Mr. Reichert’s interview with the RCMP was interrupted (and recording stopped), while he revealed that it was indeed, Mr. Reichert himself that told then premier Gordon Campbell of the ongoing investigation and the details about Erik Bornmann’s confessions, including those related to Pilothouse Public Affairs and the operation that led to the charges against Dave Basi and Bob Virk.

Why the tape was turned off is anyone’s guess, but the note to file with ‘Do Not Disclose’ across the top, is part of the package currently being requested by the major media outlet I told you about last week.

In addition, in the same disclosure package being currently sought, are specific details with respect to the testimony of one Erik Bornmann–the so-called ‘star witness’ for the prosecution. During his second (part) interview with the RCMP, Mr. Bornmann, now practicing law in Ontario, intimates that Kelly Reichert told Bob Virk that it was indeed Mr. Reichert who provided the inside information regarding the investigation to Mr. Campbell and that the information was obtained by Mr. Reichert from conversations he had with his brother-in-law, RCMP and investigation lead Sgt. Kevin Debruykere.

When asked by the RCMP investigators how Mr. Bornmann knew of this information, he stated that it was disclosed in conversations he had with three people.

Jamie Elmhirst and Bob Virk.

And Christy Clark.

Jamie Elmhirst was his business partner and friend. Bob Virk was also a friend. And Christy Clark was a constant source of Cabinet leaks, as I have proved, time and again. They–Clark and Bornmann, had also exchanged much information between them about the mechanics related to the sale of BC Rail.

And all of them–Messers Elmhirst, Bornmann and Virk, were part of Christy Clark’s political squad, with Mr. Elmhirst being one of the lasting capos in the Clark political mafia. He worked on her successful BC Liberal leadership bid and remains inside the circle.

The two events above; the RCMP interviews with both Kelly Reichert and Erik Bornmann, raise all sorts of questions.

Chief among them:

How on earth can the RCMP investigation team not expect very serious questions to be raised about their seeming incompetence through the investigation (or is that willful, participatory ignorance?), when there were clear reasons to ask weighty, stone-faced questions of Christy Clark? Why was she repeatedly named as a source in Mr. Bornmann’s documents and then named as a source for inside information? This didn’t move the RCMP at all? Why was her assistant, Kim Haakstad–who is now her Deputy Chief of Staff, not interviewed, as she, too, was a constant visitor to and political collaborator of Erik Bornmann?

You’d think anyone connected to Erik Bornmann–including his barber and manicurist would be interviewed, considering he ADMITTED TO BRIBING PUBLIC OFFICIALS and was bloody well surrounded by them at all times.

Did he bribe anyone else other than Dave Basi and Bob Virk? What was in it for so many others that helped both him and Brian Kieran to obtain such inside information, sensitive government information–including Cabinet information??? Anything?

This thought never crossed the minds of ANY of the investigators??? Not one?!

But there are other issues, as well.

Quite apart from the obvious question regarding the conveniently missing ‘Do Not Disclose’ document that appeared and then disappeared, only to reappear again, why was Erik Bornmann’s testimony regarding Dave Basi and Bob Virk considered “star” quality, while his statements regarding Kelly Reichert and lengthy notations regarding Christy Clark not even investigated? How was he credible in matters related only to Dave Basi and Bob Virk? A star witness’ integrity would be even throughout, would it not?

Because if it isn’t, then the veracity of his statements that crucified Dave Basi and Bob Virk must also be disregarded, no?

Remember, too, that when Erik Bornmann’s apartment was first raided and cheques to Aneal Basi were found in his den, Mr. Bornmann professed that they were for “legitimate work.”  Aneal Basi, in fact, worked for the Public Affairs Bureau at the time, as a writer. Then, when Mr. Bornmann declared Kelly Reichert’s inside RCMP information to be from Mr. Reichert’s brother-in-law–who led the investigation, this was obviously ignored by the RCMP.

But when Erik Bornmamm fingered Dave Basi and Bob Virk, the RCMP provided evidence, often in selective pieces, to assist the prosecution in establishing the guilt of the accused.

Any exculpatory evidence was either left in files or disappeared and needed dozens of disclosure applications by the defence to see the light of day.

Sorry, tell me again…? The BC Liberal Party isn’t the most corrupt political party in BC history? Ms. Clark conducted herself in government “spotlessly?” Erik Bornmann was a reliable witness? The RCMP conducted an impartial investigation? The Special Prosecutor’s office was never in a conflict?

It amazes me, still, off even such small revelations in the general scheme of this hulking, prodigious scandal, that so many in the mainstream press like Keith Baldrey and Bill Good have the temerity to declare this all “yesterday’s news.”

A full inquiry, but with specific terms is the only way to apply the disinfectant to the government benches considering the absolute disgrace of the Campbell/Clark government.

Oh, by the way, in case you haven’t heard: The Premier’s China junket (her most expensive photo op yet) has yielded a big score: More planes from China will fly in and out of YVR.

Honestly…that woman has no shame whatsoever.

    this whole investigation is corrupt.

    when the do not disclose file comes to light you have to ask what else has been withheld.
    this can give basi and virk a opportunity to ask for their convictions to be overturned.

    what we need is a truly independent public enquiry with a broad mandate. the commisioner and staff should no ties to bc at all.

    the rcmp should open a code of conduct investigation on all of the investigators on this file. the results should be made public.

    christy clark is defined by her actions and lack of actions

    the people of bc deserve better. at least adrian dix owns up to his lapse of judgement re glen clark .

      The “occupests” have lost focus of what the original cause was (and for some of them, it’s an excuse to just behave like assholes, like causing shit in a CHURCH). People involved in a protest are not going to sit around smoking cheeba all day, nor will they tell you to fuck off and hurl insults at you if you come down to their campsite to try and talk to some of them. They won’t take one look at you, see you wearing a leather jacket and carrying a Coach tote and bitch you out for being part of the 1% instantly.

      These “occupests” are just using the movement as an excuse to camp on public property. They can’t answer you properly if you confront them with the original manifesto, they just call you a corporate whore. They refuse to recognize the police force and fire department as law enforcement agencies (let’s hope they don’t need to call 911 because someone got shot or they set the place on fire) and they think that being an unemployed pothead bum entitles them to $4000/month welfare. They refuse to even think of getting a job at McDonalds or Starbucks yet patronize those very businesses, conveniently forgetting that they are corporations that they so loathe.

      I could go on but that pretty much sums it up. You agree, AGT?

    Brian Kieran admitted on the 6 o’clock news that he did not “see anything wrong” with sharing that illgotten information with his client…..Omnitrax….one of the bidders for BCR.

    Please tell me why Kieran is not in jail?

          Go to Monterey and Palm Desert Drive and check in to a booth at ‘Castelli’s’. Old school Italian fare (similar in style to Rao’s in NYC–Little Italy)

          Order Castelli’s signature lobster ravioli and a double garlic bread with extra cheese. Or order ONE Godfather dinner and split it among two.

          Superb food, consistent service and the pain in the ass–wallet pocket, is considerably less. Trust me.

          But Ruth’s Chris in the desert is my favorite place to eat. Just such a high quality. $500.00!? Only?!

    Today was a very sad day in in the BC Legal System..actually for the past 10 years this government has become so corrupt it frightens me..
    It also makes me wonder who is the wizard behind the curtain calling the shots?

      1) Hard to say. Legal wrangling and statute of limitations may preclude charges.

      2) It doesn’t. Basi and Virk have ironclad agreements with the Govt. on true legal fees, etc.

        I really don’t care if charges are laid or not as they would simply result in an expensive protracted charade with key evidence being supressed and minimal penalties in the unlikely event of a conviction.

        I simply want the truth and the only way of getting that is a public inquiry with each one of these weasels forced onto the witness stand. They’ll turn on each other like a pack of dogs.

    Once again Alex you have formulated MORE questions that the R.C.M.P. and our currently sitting MLA’s must be held accountable for.
    I heard Shirley Bond on the radio this afternoon state that NO politicians were involved in the decision to award Basi/Virk’s lawyers 6 million taxpayers dollars.
    Well, I guess that puts it all to rest. We have heard from someone who would know.
    Unless there is the off chance that she is lying through her teeth to her constituents.

      I suspect the latter.

      The chain of command went Campbell to Seckel, Campbell to deJong. And then Oppal to Berardino, Oppal to deJong.

    I sincerely wish you could tell more about the reason this media outlet is digging and want these defence documents now, after so long. There are people that know many details about this scandal, and the only reason they are not saying anything is because NO ONE HAS EVER ASKED THEM. Keith Baldrey has declared this old news but I guarantee you he has not done ANY digging. He may have called up his contacts for their opinion but he should not be confused with an investigative journalist. He is a talking head clown to the people that know the truth. There have been no investigative journalists that have asked questions, none. That to me is the biggest head scratcher. Can you say if they are going to do any digging for truth or is this just for some other odd purpose that will fit this whole sordid mess?
    I expect you will not be able to tell more and that it will likely be worth the wait but there are people just waiting to see how they can fit into this puzzle and tell what they know. There are good people wanting to see justice done.

    It seems that Christy Clark’s and Gordon Campbell’s political squads have advised them that the Liberal government of this province can hide behind a perverse form of the Royal Prerogative. It is obvious that the capo Mr.Elmhirst knows this concept and has advised the Clark political mafia that there will be, more than likely, no consequences for the governmental decisions that they make on behalf of the citizens of British Columbia.

    If a whistle blower officially tells that he or she knows of government corruption, it is likely their life may be ruined or as Basi and Virk both know that if you get involved in political corruption on behalf of your mafia handlers, you will face a lengthy lawsuit that is worse than a root canal.

    As Michael Smyth stated in a recent column. Gordon Campbell is sitting in his office in London and laughing his head off. I wonder why.

    Quite a day for news- and your article appears the same day the CBC news runs one how the payout re Basi-Virk is “unusual”.
    The taxpayers of Canada have been paying quite a chunk of cash out lately- betwen the Boss payout of $30 million, $6 for Basi-Virk, and I see we have been paying $1.3 million to fight the federal Tories as well.
    Good article, by the way- it still blows my mind how this isn`t across the front page of major newspapers.

    well, at my age I suppose I can be easily confused; however, IF no politician was ever involved in the Basi-Virk hush money, how can Basi-Virk have an iron-clad deal (re: repayment of legal expenses and gag order) with ‘the government’???

    I am assuming from my experience that ‘government’ is our properly elected MLAs, who are appointed in some cases as ministers who have then penultimate responsibility to ‘make decisions’ and sign legal documents.

    IF none of our properly elected POLITICIANS were involved, we should be calling for the heads of the assistants and bureaucrats who presumed an authority over and above their designation. And if I believed that it was carried out by desk jockeys I would have a bridge in my back yard.. transported from Arizona.

    The whole thing stinks Alex, and I am ecstatic over the hard work and personal sacrifice you have given and are giving to shed light on this disgusting scandal.

    One question. The Limitation act does allow for “postponment” of time limitation’s in certain Breach of Trust cases. I believe that this also occurs for specific types of fraud. I am not a lawyer, but this does open a very interesting door, does it not?

He attended everyday but seems, particularly in his latest screed, not to have much idea about what was really going on.

    Good article Alex. I’m sure stomachs are churning with every article you and others publish regarding this illegal sale. A recent trial in Ontario was allowed to continue despite the statute of limitations.

    Let’s hope that with a new government the statute can be overrided because of the interest of the public is considered more important than the statute.

                  I called David Berner some time ago and asked if he knew, since I met David from North Burnaby in Berner’s eponymous blog. David knew nothing of DofNB’s whereabouts.

                  I sent several emails which all bounced back.

                  As for Norm, he suffers from an overabundance of kindness. Some of his posts are littered with comments from blogosphere hooligans like those with defamatory blogs in the Kootenays and from Garden Bay. you can’t allow people like that on your blog–period. Harvey does it and suffers for it. Norm banned one or two, but, like me, let them back on when they were polite. But you see, you can’t do that. I will never let those people on again.

                  On the other hand, those seem to be the only commenters Laila has…LOL! Pity, so much promise once upon a time…

    This is just fantastic and I greatly appreciate the hard work and tenacity you have exhibited in holding the taxpayers’ employees feet to the fire.
    My two cents.IIMO, I believe that the new billion dollar RCMP headquarters was a payoff and DeBruykere becoming an inspector now, along with the judge getting boosted up and out of the BC Rail trial both payoffs.
    All people involved, even the cops, should be doing hard time in the slammer for their criminal deeds.
    This stinks so bad, that I am loath to see what has been done to other public holdings (BC Hydro, ICBC) and how much has been stolen out of those companies.
    Rich Coleman, being a former cop, is,IMO one of the dirtiest (knowing the laws and how to subvert them), and it seems whatever portfolio he has control of, has scandal written over it.
    That seems to be the Liberal Modus operandi.
    I believe that only way to change what has been happening over the last 30-40 years concerning our politics, is armed rebellion and politicians’ heads on a pole.

Although I no longer watch, read, or listen to corporate news sources (or the CBC for news), I did see a news broadcast before dinner with a friend a month or so ago. Although my friend doesn’t share my politics or follow the news that closely, she commented on Keith Baldrey, saying, “Why does he look so red-faced and nervous all the time?” I knew better than to say anything, but I did smile inside and think of you. Of course, it’s not really funny. It has to be stressful when you have a conscience but the terms of your employment and your family’s livelihood depend on doing/saying otherwise. I base this on your previous post suggesting the goodness of the man behind the part he plays on TV.

    The real battle we have yet to fight, is the one on corruption in high places in British Colombia. Honor the sacrifices our true hero’s have made, by putting organized crime and their political organization out of business and their members into prison.

    Just speculating here… Premier Snooky, heavily implicated in the Basi mess, (not speculative!!!). Power hungary, skill-less, makes a deal with the Boyz (McLean, Collins, Berardino etc.) that if she is premier, there will be no inquiry. It is a no brainer as far as covering the whole thing up. She has a vested interest!

    I would love a piece on Carol Berner. I almost puked last night watching the news. Her lawyer actually had the gall to state that because the child killer sat in a police car for thirty minutes, without being read her charter rights she deserves a free ride! Are you kidding me? I am am sure the officer was a little pre-occupied with the dead four year old girl on the side of the road. I pray that David Tarnow does not have children. They should lock both of them up in one of those jails in gutonimo bay. The lawyers have ruined the charter, I would gladly trade it in for a litle justuce and common sense. Thirty minutes to further sober up in the back of a police car, my God, what a travesty….

    Alex i re read this and its almost scary how the RCMP simply sleep walk through this to give friends an easy trip to court , shows why RCMP involved should have come from a division elsewhere with no ties to any BC govt officials at all , thats something that should be addressed maybe any political criminal investigations should be taken into a federal court i know that is difficult under our current system but we see the one we have now is strongly influenced by politics how do we find a way to change that ?
    It would be one part of keeping politicians honest as they would know there is no fee pass regardless of what party .
    Just some afterthoughts on the whole issue we need a way to impartially investigate such issues i dont have any easy answers but what do others think what can we as voters ask for or demand for the future in such case?

    As usual, great comments. Like the rest of people here, I can’t wait for the next installment! Perhaps, in the future, investigations of this sort should be overseen by a combination of local Police, and the RCMP. As soon as you start looking at Judges and special prosecutors, a lot of them have ties to people in political life. Not unlike the Mountie sgt who is now an Inspector. The proper thing for him to have done in the 1st instance would have been to remove himself from the investigation.

      Precisely. I met with Kevin DeBruyckere many times and I always found him a stand-up cop; a very decent man. Why he did this is beyond me. It doesn’t the profile of the man at all.

    Since no MLA wrote off on the $6million is there possibly a way for someone to file a class action suit against the BC government for the people of BC (the BC Government) to get the peoples money back? A convoluted idea ya, but… Just imagine the headlines around the world.

        YaButt, It would plant a seed in the minds of the electorate. Sometimes that is enough. Just imagine the headlines “People sue their government!” There has gotta be some pro bono Zalm types willing to organize it. Heck I would even throw in some coin just for the entertainment value. Me thinks it would be a hoot watching Snookie & Co. try to de-toxify it. Might even give Martin & Olsen something to do.

        So far this $6 million thing is like the weather, every one complains about it but no one wants to do anything about it.

      Crimes against Canada ??, nope, this pay out and corrupt government is 100% B.C., It was not Canada”s railway stolen, it’s not Alberta or Ontario paying the legal fees of two confessed criminals, nor is Nova Scotia or Saskatchewan paying the 35 million to boss minerals, nope it’s British Columbians on the hook for all these messes 100%.
