It wouldn’t be the first lie Mike deJong told. But before we get to Meandering Mike…

Let me take you back to the fall of 2008. There had been a series of disclosure challenges in the trial of ‘Basi-Virk’ that were clearly going in favour of the defence. Time after time, step by step. Kevin McCullough and Michael Bolton were peeling away, with surgical precision, at the case against their clients.

I’m told that this was a troublesome condition for the Special Prosecutor. Having secured the star testimony of Erik Bornmann, they were growing concerned that with Bolton and McCullough on such a tear, by the time the trial came around, they’d make sushi of Bornmann’s noted “nervousness.”

So what did they do?

In a strange twist, instead of dealing with the actual legal issues related to the pre-trial matters raised by defence counsel, the government, YOUR government, released a 25% holdback in legal fees.

Not aware of that? Let me help. Up until that point, the government was sure of its case, but when Basi and Virk’s lawyers established a thunderous winning streak before Madame Justice Elizabeth Bennett, and started to touch on former players, inside and outside the government–like Patrick Kinsella, out of nowhere, the holdback of defence legal fees was released.

From the beginning of pre-trial proceedings, legal fees were paid minus a “25% holdback.” This is significant in that the purpose was to ensure the government was left holding something in case Dave Basi and Bobby Virk were found guilty.

Then it gets interesting. Providing no reason as to why the holdbacks were released, and as all future bills were paid in full, in 2010, counsel for the defence received a letter from one of Mike deJong’s immediates, that actually stated the first settlement offer, predicated, incredibly, on the fact that the defence had strung along a whole series of pre-trial and at trial wins. So why not settle?

This, in and of itself, blows the theory out of the water that Mike deJong knew little, if at all, of what was specifically going on with respect to the deals offered the defence. How is it possible that deJong wouldn’t know his own Ministry included a letter with the very first round of offers to settle; the first of which included the threat of jail time in a prosecution led plea?

Translation: ‘Settle ASAP and we’ll take jail time off the table. We paid you your holdback a couple of years ago hoping you’d get the message without us having to spell it out, but now since Collins will take the stand and your lawyers are likely to demand he be followed by any of Messers Kinsella, McLean and Campbell, we really need you to settle quickly. Get on with it.’

The major bomb shell, though, is this: In one of the first letters, the government ADMITS to the defence successes in court–effectively confessing that the government was LOSING its case–IN WRITING for Christ’s sake. Who does that? Who was the negotiating genius behind that I wonder? Does that sound like a lawyer to you?

Or a politician?

Of course, it begs to ask Bill Berardino why it was, post facto, that he made such outrageous claims, of being so sure of his case–and could have prosecuted it anyway, when the Ministry that charged him with the task of prosecuting the case are writing letters to the defence, almost a year before the trial began, wherein they admit to falling just short of being resigned to defeat?

Mr. Bereardino, remember, told us it was a financial consideration that ended the case: Then why letters premised by the defence successes in court? This is completely outside what any lawyer would typically write in such an instance. In first year law, they’d fail you for such unrestrained frivolity.

Perhaps I should speak directly to the Auditor General for a minute…

These documents, which you should immediately demand Mr. Doyle, are included in the first and second rounds of communication between this government and the offices of defence counsel in Vancouver and Victoria (they are located in the binders held by the AG in ‘main block’–you’ll know what that means). They cannot be moved or destroyed without permission and were there as recently as 72 hours ago. But the suggestion has been recently made to “move them.” Speak to David Loukidelis, he’ll know exactly what I’m talking about, although I’d guess you won’t get very far. He has a habit of doing that. He personally arranged for that correspondence through Mr. Butler’s office at the time the offers were made to Messers Basi and Virk..  The correspondence began in late winter and early spring of 2010.

Now, why am I doing this? Because the Auditor General is being completely shielded from relevant documents and being the helpful chap I am I wanted to make sure he had this information.

Think about this all for a minute: After almost nine months of being thwarted and obstructed from obtaining the relevant documents to the settlement with David Basi and Bob Virk, the Auditor General goes to court, wins the right to the documents–immediately after which, the Premier falls inches short of throwing a full-on temper tantrum in Cabinet after then Attorney General Barry Penner refuses to appeal the courts decision.

“Open and transparent,” says Ms. Clark of her government while she’s STILL doing everything she, er, excuse me, they can to stop the Auditor General from getting at the truth about the six million dollar settlement, which bought the silence of David Basi and Bob Virk.

Why?

Well, I’ll let you guess.

    You have me laughing in a wicked good way. The defence was on quite a roll for awhile. I am still giddy from your news on a major news source applying for the defence docs. A rumour we heard last year on this site. When and if those docs are released, I will be one very happy man.

    Mike’s flip flops told quite a story in the days after the trial ended. Looking forward to more good reading. Keep on digging.

      I had one of those parties once….ONCE. I took me six months to: get my car back from my Dad, the moratorium on evening excursions lifted, phone privileges returned and a key to the house.

      During the same curfew period, I once was too late getting home from UBC, (it was fall and it got dark earlier and the bus wasn’t on time and I had a lab exam) so he shut the front gates and wouldn’t allow anyone to speak to me by the house phone. I tried to explain and he’d have nothing of it. I ended up sleeping at the neighbor’s house.

      The old man sure knew how to lay down the law.

    For one not to see this, you must be blind or guilty.

      Indeed. The transcripts of the trial, including pre-trial, should be available to everyone. Those were words spoken in the people’s court. The transcripts belong to us.

        If Mr. Doyle now has the Order and the appeal period has passed, thanks to the decency of Mr. Penner, what exactly is the government doing to prevent Doyle from accessing the documents?

        And why isn’t he going public with it?

          I’d also mention that the reason the Special Prosecutor was appointed in this case was to keep conduct of the case completely independent of government because it involved government officials.

          So why would the A-G’s Ministry involve itself in the conduct of the case by trying to negotiate a plea? Firstly, no way would this happen without direction from the A-G himself, and, almost certainly the Premier. Secondly, any honest Special Prosecutor would would ask the court to allow him to withdraw as soon as he became aware of that sort of interference.

          Because he’d compromise his report by breach several protocols.

          A few members of the Govt called yesterday to express their outrage. Apparently, the Premier spoke about this at a recent caucus meeting, not the one yesterday but the previous one, and she mentioned how things were proceeding with Doyle and he was unimpeded as far as she knew. Bond nodded in agreement.

          Well, both are liars. How is this possible? He’s not getting ANY cooperation at all.

    Alex the anticipation is freakin’ killing me…what i’m hoping to be revealed is a hunch i have that Basi/Virk recieved more than the reported $6 million to cover legal fees. Part of this hunch is from
    the exchange btwn Deep Throat and yourself. Thank you Alex for your comitment and dedication on this most egregious abuse of public office, the public purse etc, etc, Thus exposing the perverse mis-handling via the special prosecutors office, A/G’s office,the RCMP and finally the MSM.       I think Gordon Campbell has everything to worry about.

      If there is a public inquiry or any review at all and Bob Virk is under subpoena to testify, Gordon Campbell might have to resign as High Commissioner.

      That’s as far as I can go. But I guarantee you, Virk, after the brow-beating and abuse he took from Campbell–to ensure the deal was going CN’s way, should have some VERY interesting things to say.

            As an American colleague told me the other day in reference to the Obama administration, I think Campbell, Clark, deJong, et al are starting to hear the strains of ‘This is the End’ by The Doors playing in the background and getting louder by the day.

            You are owed a huge debt of gratitude by the people of BC while the MSM deserve nothing but their scorn.

            And George’s line about ‘a freedom that you can’t imagine..’ is absolutely true. I’ve had a lot of people look me in the eye and tell me that, I’ve just never heard it put quite that way. I also hope that Basi & Virk are reading because it’s never too late to do the right thing and they will feel so much better.

              I’m not sure what they’d do. I know both Basi and Virk would testify at an inquiry. I asked them both that question one day after their trial ended and yet both confirmed same.

              Other than that, Virk politely says how busy he is and hangs up the phone any of the few times I’ve called him and asked if he’d like to comment on one thing or another. And Basi just laughs at me when I try buy his old Mercury off him (it’s a collector’s piece). I actually think he’s a bigger old car nut than me–which pisses me off to no end.

          I’ve heard lots of stories about other MLAs, ministerial aides and such taking abuse from His Excremency. I even heard one story (unverified because I don’t know the source very well) that ol’ Gordo was abusive to one female in caucus, saying “I’m sorry you’re on the rag” and then flipped her off. Why she never did anything about it I don’t know, but I think a lot of them were scared that he’d flip out and start throwing knives at them.

                  I think Bill Bennett is a really honourable man, who has completely lost his way. He said the same things to me. Although, anyone that knows Campbell, knows that he is sexually ill–he’s got a screw loose for certain. I knew drugged up out of control frat boys who acted with more control.

                  Regardless, Bill’s is tacit support of Clark’s insanity is a case study in the battered wife syndrome he once noted when excoriating the former premier.

    That was an excellent post, Alex. It shows your outstanding skills in research and deft touch at narrative are still undiminished after close to a year of dropping BC Rail bombshells. If there are any loyal members left in the BC Liberal Party, they should bear in mind that it was the backroom machinations of one Mike DeJong that enabled Ms Clark to PIN down the support necessary to win a 50-50 draw in the leadership race.

    However, the BC Liberals, despite taking significant body blows from the revelations posted here and by other emerging scandals, will likely remain impenitent, callous and hard-hearted. Rather than examine the evidence you continue to supply, they chose to spin denial like this: “We know that British Columbians see here as the best possible premier for the province and as she leads us and as we go forward, people will get a chance to see the kind of record that we can build going into the next election.”

    Mary Polak’s remarks (complete with Vancouver Sun typo) will boomerang. They will come back to haunt her and the BC Liberal government. Voters have already had ample opportunity these past seven months to see the kind of record Ms Clark can build, photo-ops notwithstanding. Couple her past BC Rail involvement with current accomplishments of her Family First campaign: the fiasco in CLBC, the impending shut down of Valleyview in two weeks, and radioactive settlements when needed that drain the provincial treasury and voters have all the proof needed that it is past time to clean the People’s House.

        NDP – 40% (+3)
        BC Liberals – 31% (-12!)
        BC Conservatives – 18% (+13!)

        The NDP haven’t really gained anything more than their customary ~40%, but the big story is the huge gain made by the BC Tories at the expense of the BC Liberals.

        Now, if they can keep a lid on bozo eruptions, the Tories may be able to supplant the BC Liberals as the party of choice for British Columbia free-enterprisers.

    And as I listen to John McComb this afternoon, not a peep about this most egregious theft of public property ever in this provonce (and continuing with Hydro, et.).
    From now on, every time I phone into any talk show, I’ll be telling the BC Rail theft and fraud caper scenario and direct them to this story.
    That mug DeJong will finally get his comeuppance, one he so richly deserved for too long, IMHO. I just new he was dirty…….And what about BC’s AG, how can we trust this so called “institution” anymore….
    Does Canada have an extradition treaty with the UK for traitors that are appointed to “High” places??? Or will he get to bounce??? What about those cads in Ottawa, will they be immune???
    My take is that Paul Martin and his ilk (Desmarais criminal cartel) have their hands all over this, like they do all over Eastern Canada.

    I see Christy just can’t get enough shipyard worker hugs can she ? How long does she milk this cow ? Considering she had diddly squat to do with it, it’s hard to stomach seeing her toss back the champagne like that while she “presses the flesh” in the Victoria yard while the “not normal” families under CLBC suffer.

    As far as a photo op with those families in the crash, that is sickening. Any leader with an ounce of character would do it behind closed doors. Her attention-ho days are coming to an end and couldn’t be soon enough. Keep it coming Alex.

      I only thank goodness al Qaeda has not attacked BC, for this Premier would make a photo op of it instead of do what Sir Rudy did during & after 9/11… unlike Kevin Falcon or Mary Polak or Alise Mills.

    Whilst being in the unfortunate position of seeing first hand the sleaze and unethical behaviour that permeated much of the provincial govt. when Campbells pals started to run the show in 2001, my colleagues and I would look at each other in disbelief frequently asking when we thought the bottom of the barrel had been reached, ” can it get any worse” in short it did. 10 years on I still ask myself the same question, thanks to you and other folks of conscience.

    What I can’t get my head around is where is the NDP on this? I do understand that they have less access to the media than B.C Christy
    ( Ye Gods!) and her for now compliant gofers, but sureely tey must be doing something with this issue, or are they sitting back letting the liberals implode, letting the blogosphere do their work for them or.??

    We got to the point of you possibly spending Christmas in jail along with the drawn out associated legal battles.

    I am SO going to relish Chrispie being crunched! I have disliked her (hate is too rich an emotion to waste on her) from even before she was in the running for Lib leader. My exceeding low opinion of her then has since plummeted, sadly along with some MLAs that I ‘thought’ had some cojones. I feverishly post your blogs on any and all forums I belong to as I feel it is imperative to get the word out to people who have been led to slumberland by most MSM who have failed to do their job this past decade.

    BTW – I cannot find the photo op of our bubbleheaded unelected preem with the families of the YVR crash. Can someone direct me there? What a crass, self-serving B..oops Witch to capitalize on this tragedy in the hope of appearing ‘compassionate’… Families First – my fat ass!

Were Campbell hauled back from England (what’s he doing? teaching them how to drink?) I’d happily travel to whatever airport he lands in to welcome him back – tho he probably wouldn’t appreciate my sentiments.

    I saw Vaughn Palmer on Global at noon explaining how the LIEberals are tanking. Made my day. Now if the NDP and/or Conservatives would just start hammering, maybe they could seal the coffin.

    What I, and I suspect quite a few others, would give to see some competent people with a code of ethics take the place of this bunch of corrupt crooks in Victoria.

      I was dropping off my youngest daughter at school the other morning (my oldest girl has been convalescing at home after a tonsillectomy) and right infront of me was one of Campbell’s best pals, in a shiny black Bentley, dropping off one of his granddaughters.

      This is someone I’ve known for twenty five plus years. A super nice man (whose down to his last few billion poor guy–and no I’m not kidding) with a usually marvelous disposition and with custom-tailored cashmere coat flapping in the cold, cold wind, walks up to my driver’s window and says, “Do you think you could lay the fuck off Gordon and the BC Rail stuff? It’s a dead issue. You’re pissing off a lot of really powerful people in this province, including the Premier who can’t stand the mention of your name and wants to do something about you but isn’t sure what yet. Think about it Alex, the Webster days are over. I always thought you were one of us to be frank. What the hell happened to you? Why don’t you back down to the US and build some more housing communities and forget this media bullshit. You’re a really smart guy, act like it. Anyway, give my best to your father and gimme a call some time and we can have lunch. I can talk to you more about this.”

      Oh, how I hate upsetting the Premier and her predecessor….but lunch sounds good. I’m always the one buying, so a freebie sounds good, no?

The bottom line is this: innocent people do not spend so much time and taxpayers money trying to prevent all the facts being presented to the people for their consideration. In this case the guilty are not only those who did the dirty deeds, but those that helped them hide it by lies, intimidation, or just refusing to ask the hard questions and report on it. If someone wronged one of the ” powerful ” how quick would they be to ” lay off ” ?

          None taken but I can hardly blame the guy. I’m no your traditional insurrectionist and this is most certainly what irritates my critics on the far right and far left. If you look at my bio it reeks of privilege to some people but when I talk about it people are taken aback by the recitation of my scars and not my medals.

          I was almost broke and love to retell the lessons. I’ve had several failed major relationships–all of which were my fault, except for my first marriage. I have friends who are judges cops, bakers and bikers–and I’m equally proud of all of them. I turned my back on sitting around and dallying with a considerable family fortune.

          I won’t hate the rich and I don’t pity the poor. These are qualities I didn’t just come up with–I feel them with every fibre of my being. This is a threat to some people. I’m a populist/libertarian more than a philosophical conservative. I care about the environment but I’m not willing to believe in hooey and alarmism. I love God but I’m convinced he’s a golfer who takes days off.

          Anyway, I hear again this morning that the Premier’s people are devising a plan to “ruin me.”

          Well, I sure hope they know what there getting into. That’s all I’ll say.

    As distasteful as this all is, I hope that you are getting immense satisfaction from the authentic investigative journalism that you’re doing. I have no real connections, power or influence beyond my personal and professional networks and yet I’ve always known intuitively how very wrong things have been since the supposed Wilson/Tyabji ‘scandal’ that cleared the way for a decade of corruption. Although the truth as you’ve posted it is yet to be widely known (though I KNOW that it WILL), reading your blog is lso refreshing and liberating. It is like awakening from a decade-long nightmare in which easily distracted and definitely deceived voters have unwittingly or fearfully chosen to forego the values and integrity of the past and dreams for the future in favor of a cheap tax cut (that favors the wealthy or is replaced by a service fee) and the cheap allure of an Olympic medal for a chosen few. I can’t get enough of this blog! The exposing of all this dirt ironically gives me hope for a cleaner, brighter future for future generations.

      They “won it” according to the process as laid out by the Govt that’s how.

      They will claim that all was above board and any of those charged and convicted were shilling for OmniTRAX.

      Getting it back will be impossible, even in the unlikely event that you could prove there was something underhanded committed to by CN or any of its officers. But I’d love to see they’re cheque register for the years of 2001-2004. That’s all I’ll say for now.

    I found this statement by a Judge of BCSC relating to a request for higher fees for Their Council then what is typically paid this decision is good reading if You want to see how some trials are funded, and what They have to go through (AG) 65] The LSS has tried to reign in indiscriminate and prolific costs with case management practices and SCAP, but sadly, when the Attorney General is approached for “special fees,” and engages in negotiations with counsel who seek a richer deal, cost and common sense take a back seat. This is evidenced by the enormous legal fees paid in the past in the Air India, Pickton and Basi and Virk trials. The Attorney General has stated that a counsel rate of $250 per hour is unsustainable, in an apparent move to reign in public spending on legal fees. There seems to be little political or public appetite to perpetuate the process used to determine fees and number of counsel as has occurred in the past.
