EXCLUSIVE BREAKING NEWS: ‘Basi-Virk’–Will the Boil Finally Be Lanced? Auditor General Fighting for Documents from Attorney General’s Ministry

106

First they ignore you….

Since the very first BC Rail piece I did in 2006, I’ve been growingly concerned with the lack of media attention to the story.

I realize it’s complicated when you start to compress ten minutes of tape into two minutes of reel for six o’clock. But that’s the case for everyone–no exceptions. An editor and her deadline; a producer and his cut-off, it’s the same for everyone.

When the book is eventually written on this festering sore; when the real truth bubbles to the surface (well before any book), most of the mainstream media won’t look good at all. Major players will have to answer for their complicity in covering for the utterly corrupt BC Liberals. Senior columnists, with any conscience, must hang their heads in shame. One bureau chief of a major network in particular, will have no reputation left and that’s if he’s still employed.

Why?

I’ll tell you. It’s been almost a decade and the only chap who can hold his head up high for the full on coverage he’s provided is Bill Tieleman of 24 Hours and The Tyee online. No one has done a more thorough job, no one has delivered as he has. He is followed by Neal Hall of the Vancouver Sun. That’s about it. None of the ‘Big Four’ (Palmer, Mason, Baldrey and Smyth) can be proud of their work in this regard. Particularly Keith and Vaughn, who dropped the ball at some point. I have my suspicions as to why, but I’ll keep them to myself out of respect. Smyth of the last few years, yes, major kudos for his work and Mason, yes again, but the sometimes soft shoe when a boot was required isn’t “balanced journalism” it’s either you cowered or you’ve got a timid editor with little professional integrity. Because I know Gary, the latter is definitely the case.

When I started in on ‘The Basi Files’ (you can search for them in my toolbar) last fall, the whole province came unglued, not just because of how Christy Clark and others were revealed to be complete liars, but because it was the first real look into what might have really been going on behind the scenes. Gordon Campbell as Machivelli. Christy Clark as Blanche DuBois.

Global TV, to their immense credit began to follow my trail and we worked very well together. But that was before the threats to reporters and higher ups by the current Premier’s henchmen and operatives.

Then they ridicule you….

But it wasn’t enough for the naysayers in the blogosphere (who are still howling at the moon). I am a ‘latecomer’ in covering the story (wrong). I have revealed nothing (really?). You see, the problem for them is that I’m not an NDPer. I never will be. And at that point, the only revelations on the BC Rail/’Basi-Virk’ trial that had come to the fore were from far left wing loons that were only doing it to elect the NDP and going with supposition and heresay that was almost entirely wrong. Tieleman, although an NDPer, was the only one who provided broad, BUT FAIR, coverage. Even Bill was pilloried because he, like me, wouldn’t howl either.

When I also began to reveal the ‘Basi-Virk’ court documents that no one else in the country had managed to get their hands on, the wheel started to turn. Dozens of media members, some very high profile, all cheering me on–but quietly. Phone calls and notes poured in, with caveats about trust and requests for confidentiality. As one put it: “When my career is over, I’m still going to remember what you did on the BC Rail file as the bravest set of stories I’ve ever seen. Bill (Tieleman) never had your sources. Your Christy Clark columns should be included in journalism schools across the country as how to skewer a liar, as far as I’m concerned.” Ms. Clark herself questioned the authenticity of the documents, even though they were confirmed by both CKNW and Global TV.

But it was clear: Most were going to stay away, authentic documents or not.

So, I began to wonder why. Why wouldn’t all these committed media people take on the establishment that has clearly lied to the people. Isn’t that what we’re supposed to be doing? Cradling the public trust?

That no one else delivered what I did is untrue–I still maintain that Tieleman eclipses everybody in this regard. However, I found it amazing that the cowardice for others continued, particularly in light of the overwhelming evidence against the BC Liberals, Gordon Campbell and Christy Clark–specifically.

Roll forward to one week before the BC Liberal leadership vote. This package was released by me, and again, all hell broke loose–although a major network spiked the story that was on tape and only hours from broadcast, for fear, as I was told, of “…influencing the leadership result. This is pure dynamite. What if Christy wins? I’m told we’ll never get a story from her people again.” As you know, the information against Ms. Clark was very damaging and her intimidation was no surprise. Remember the now infamous Squire Barnes interview where she looked visibly nervous? She’d just been interviewed moments earlier for comment on my piece and she, as I’m told by eye witnesses, lost it. So her henchmen went right to work and killed it.

After I wrote my story and published it anyway, supporters left Clark’s camp in droves and both the Kevin Falcon and George Abbott camps sent along government members to meet with me and ask how I obtained such information. Even the NDP were in constant touch. Mike Smyth, then with CKNW, along with courageous Jon McComb and Jill Bennett all covered it. So did Elizabeth James, a superb columnist with the North Shore News and the blogosphere triumvirate of greats: Rafe Mair, Harvey Oberfeld and Norman Farrell.

That would have been around the time the Premier’s operatives were heisting PIN numbers that eventually got her elected, despite Kevin Falcon’s team signed up 3,800 more members than Ms. Clark’s people. Hmmm….can’t imagine who at Bc Liberal PArty head officer helped make that happen.

Then they fight you….

That was also around the time I met with the RCMP a second time and the Office of the Special Prosecutor called to threaten me about any further releases. Since then, I’ve released dozens more documents through the summer and little if any pick up.

So there is this Brian Kieran piece that is sitting at my lawyer’s again. It’s another bombshell, as it reveals his entire statement to the RCMP and here’s your titillation: In his first of two interviews with the RCMP, Kieran, who after admitting to providing bribes to government officials is back in the Victoria Press Gallery–unaccosted by the spineless, lemmings currently members (well, a good portion of them), LAUDED both Basi and Virk as good guys. Let me repeat: In Kieran’s first statement to the RCMP, Kieran thought the two then accused were aces. But then a funny thing happened on the way to the second Kieran interview…

That’s just some of the information that turns in his second statement and provides a fascinating glimpse into what was going on at the time and how the RCMP believed one version and not another, as Kieran was yet another star witness whose so-called credibility formed part of the basis for the hanging of Basi and Virk–while the real culprits got away in a fancy railcar, loaded with caviar and champagne.

But that’s not really the BIG NEWS I want you to know about.

The big news is this: After a whole year of shaming the mainstream press to do their job on this file; after demolishing the shameless pro-Christy piece CTV Vancouver manufactured to help their pal become Premier (afterall, when you leave CTV, you retire to the Premier’s Office and are rewarded for being a bubblehead with a ridiculous salary and nine email per month limit so you don’t break a nail) some one, and I won’t tell you who, yet, has finally, FINALLY done what any station or other network could have accomplished. And all because I wouldn’t stop bitching about it to anyone in the media who would listen. I even told all of them what to ask for. Well, only one of them cares, apparently.

A major media venue has applied to received the ENTIRE defence disclosure package from the trial of Dave Basi and Bob Virk.

Do you have any idea how significant this is? It’s a major detonation, for two reasons.

Firstly, the Clark government and I expect Ms. Clark’s now battalion of lawyers watching for something like this (there was originally one, now there are four), will fight tooth and nail for the package to be denied–under whatever grounds possible. They won’t care how embarrassing the claims.

Secondly, the intimidation of this media venue will be unending, but you see, I’m also watching and will shame this government if they make one move in this direction.

How? Simple.

If Christy Clark and her minions pull another stunt to hide what was presented by the defence in the trial of Dave Basi and Bob Virk, I will go back to my source copy every single last piece of disclosure evidence and DUMP THE ENTIRE PACKAGE RIGHT HERE ON THIS BLOG ALL AT ONCE. And if I spend Christmas in jail for contempt, I don’t care. Not one bit. I might actually visit with some old friends and get some rest.

I’ve been trying to be nice, thus far–apparently too nice. I’ve revealed some very good material, but when the early June 2009 pre-trial transcripts are revealed, Christy Clark won’t be Premier for much longer. I was specifically warned not to disclose this material or risk sure repercussions. So, I’m being a good boy.

For now.

But if Ms. Clark thinks she will survive this, I’ve got news for her, she won’t. In those pre-trial transcripts, that NO OTHER media venue has the decency, responsibility or integrity to ask for, you will see precisely how Ms. Clark was clearly the leaker of important, sensitive Cabinet information and the screaming need to put her on a stand at an inquiry and ask the tough questions about her very close relationships to both Brian Kieran and, more importantly, Erik Bornmann. You will also see the dreaded-by-Clark deleted email the day after she found out her close, personal friend Erik Bornmann turned state’s evidence, if you will. Then I’d like to hear what Bill Good or Keith Baldrey have to say about the BC Rail matter being “yesterday’s news.”

Christy Clark will be wanting to stay in China. She wants this thing dead and buried in the deepest possible grave.

Doubt me? Well, explain why the Auditor General is having an impossible time getting any information from lawyers in the Attorney General’s office regarding the settlement with Basi and Virk.

Maybe someone should ask Barry Penner to rate changing diapers vs. listening to an uncontainable, unqualified shrew bark orders at him in Cabinet to cover-up the settlement materials by appealing the courts earlier decision.

Do you see the pattern, here?

My darlings, there is only ONE issue that scares the Spanx off Christy Clark, and it’s the BC Rail/Basi Virk issue. She stays up at night devising ways to keep quiet the truth about her role, the role of her predecessor (even though they hate one another–because they’re the same!) and those of their close, mutual friends who made away with untold millions.

And in short order, you’ll see why. But exercise some patience please. It’ll be worth it, I promise.

The public’s right to know may finally be honoured. I may have to help it along, if it doesn’t.

And then they….

    Excellent backgournder.

A prelude to something else, perhaps?

    • AGT says:

A long, slow, wet kiss that last for years….

      • Observer says:

A kiss of political death? Cannot wait to see it start.

      • James1 says:

        Excellent!

I see since I last read this post, you have added even more meat to the bone!

This is truly breathtaking in scope and substance.

And the fact that the court will only entertain a “respected news source” to make requests, should alarm everyone here and around B.C.

How ironic, that a so called blogger that doesn’t count, is the one that has set this all in motion; done all the heavy lifting so to speak.

What a joke; I thought the courts were supposed to protect the people.

Thanx Alex, this is what we have been waiting for.

        • AGT says:

No! LOL! I screwed up. I’ve been working on several posts and hit ‘Publish’ on the B-V post by accident. One of my readers called and started in about the post and I panicked, so I took it down, added the piece from Word I’d been reviewing and now you have it.

See, others get paid the big bucks to do a few pieces per week to lull you to sleep. I do few pieces per day sometimes, to set your hair on fire!

          • Gary says:

Call me red headed henceforth. I’ll accept your ‘splanation of a Publish by accident and a Post out of panic. I’m even willing to concede your intent was to do this in a milder manner, more timely perhaps. Doesn’t matter a damn now. While others were gathering rocks, you’ve been mining platinum. Alex. you’ve just changed, completely, the tone of how the BC Rail, Basi/Virk was going to play out. Your comment section will express how thankful each and every one of us are for your commitment to the peoples right to know. I strongly suspect two unfortunate souls will however eclipse our gratitude, they being Dave Basi and Bobby Virk. All else you’ve just done, they are most deserving of the outcome. From the bottom of my heart, Thank you for providing hope to them, and the rest of us. I love you man.

  2. John's Aghast says:

I wonder if its too little, too late. The reason I started to follow your blog about a year ago was for your insight into the BC Rail issue. Then it seemed to wane, probably for reasons beyond your control. (RCMP; OSP?)
Now I’m encouraged to see you’ve resurrected the story – but will it ever be resolved? I’m convinced that there are very big players who value their freedom to the extent that they will ensure the whole story will never see the light of day.
Will THEY still control Basi/Virk after they’ve completed their sentences? Or will the story be eclipsed by the BC Hydro crime bosses, the Ferry Fiasco, the IPPs etc.
Oh woe is me! Must I wait for Global Warming so to move to some Albertan ocean front property?

    • AGT says:

No. I told you what I’ll do. The court wanted a respected, reputable news venue to make requests. Individual reporters and bloggers don’t count.

IF, I repeat, IF they deny the application I will dump everything at once. All of it and let the chips fall where they may.

The public has a right to know–period.

  6. Alex, I was under the impression the Auditor General was given the go ahead to review the Basi/Virk pay off ? Am I missing something ?
And Alex I’ve always said that if Christy has nothing to hide her lawyers would have you in court by now. I also believe that they’re aware of the support you have…. and that won’t look good for CC.

    • AGT says:

The reason I’m still walking the streets is just as much because the OSP made the mistake of describing the kind of information that would have me sitting in front of a judge for contempt. So I’m dancing on a pin.

For now. Otherwise, I promise you, if they obstruct this media venue I’ll dump everything. Every document, everything. All the stuff they didn’t want me to include, including actual taped and intercepted conversations–all of them, without fail. Every detail. And then you’ll see why some journalists aren’t covering the story. And why Gordon Campbell wanted to go away.

And how big a liar Christy Clark truly is…

“I wish to record an occurrence which took place in heaven on the third day before the Ides of October, in the new year which began our fortunate era. I am not going to be diverted by either fear or favor. I shall tell the unvarnished truth. If anybody asks me where I got my information, I say at once, I’ll not answer if I don’t want to. Who is going to make me? I know I have been free to do as I like since the day when he died who had made the proverb true: One must be born either king or fool. Right on, Alex! Give ‘em hell! I wish the people in this government had one-tenth the principles that you (and Mr. Tieleman) do! It’s you two who deserve the OBC, not that lying homunculus Campbell.

And don’t worry — if you do get arrested for contempt, I’ll round up another 40 Nelsonites, we’ll shave our heads, take a VW-bus caravan to Vancouver and sit outside the courthouse chanting “FREE OUR FATHER! FREE OUR FATHER!” ;-)

Keep up the crucially necessary work! I wish the MSM had half your brass!

Thank you Alex for exposing the cold truth about the Machiavellian politics that go on behind the scenes in British Columbia.

  14. Jack says:

I am continuously appalled by the blatant obstruction of the Auditor General, by the Ministry of the A.G. (of which I am fairly familiar) .
The A.G. is responsible for ensuring that the public administration of B.C. and Canadian law is conducted according to those laws.
A situation now exists in BC that one (“at arm’s length from government”) ministry is doing everything within it’s power to obstruct ANOTHER (“at arm’s length from government”) function of government. Appalling in that I can very clearly remember the two having a very comfortable working relationship in the not so distant past.

What possible reason is there for the A.G. to try and prevent information being supplied to the Auditor General ??
IF the A.G.’s ministry has been absolutely above board, there is nothing to hide. IF the ministry is in active “suppression mode” then the only possible conclusion is: “they’re dirty”.
Corruption breeds best in the dark.

  15. Josef says:

Alex, great work. I am speechless.

But I also bet and I’m a betting man of minor consequence it’s Global. Global was more pro-Falcon than the others.

Sun likes to go big or go home. But they probably lack the knowledge or resources to pull off something like… THIS!

The CBC can’t make a move and nor can CTV – too many, er, alumni entrenched on Team Christy… there would be a tip-off for sure.

I also have something for you once you post your update on Heed. Alise Mills went after him today on C-FAX.

    • AGT says:

You are wrong when you say any station was “pro-Falcon.” In fact that’s just dead wrong.

Keith Baldrey’s adoring reviews of Christy right through the leadership race were tantamount to footkissing. It was embarrassing to watch. They only did two pieces on Clark that could be considered tough on her. The rest is Baldrey doing his best to anoint a completely unqualified person premier. It was truly ridiculous. What happened to hard nosed journalism? He saw the documents I was releasing, he didn’t need to wait for brave Marisa Thomas to do his work for him. So, no, dead wrong, Global weren’t pro anybody.

However, it’s tough not to spike investigative pieces when your Victoria Bureau chief is busy puckering for Ms Clark’s high heel–or worse!

  16. Mol says:

Oh Wow!! I have goosbumps!! I am so excited, so happy and pleased that you have done and are doing this thing up cooked through. IF things do happen to go south for you (I don’t want to think of that!) You have got a batch of pretty vociferous supporters here in the Okanagan who can be organized for anything you may require. The pharmacies in Victoria are down to their last few packages of TUMS and Pepto-Bismol, I’m sure.

  17. froth says:

Wow! You are loaded for Bear…. and you have both Christy and the A.G.’s ministry in your sights.

can’t wait for the ammo to hit it’s targets!

  18. VanIsle says:

    Alex,
You are a man of integrity and character, something we rarely see anymore. To put your nuts on the line like this is second to none. Never in my 35 years of eligible voting have I seen someone try to scam the BC public like she has. I can’t wait to see this bitch go down in a ball of flames. Kudos my man !

  19. Keith says:

    Hi Alex,

you mention that the NDP have been in touch with you. It’s understandable why they struggle to get any coverage on any of our alleged news outlets, but they do seem to have taken a back seat in keeping this issue front and centre, are they sitting back letting the blogosphere do what they should be doing, or??

For me your line “were from far left wing loons that were only doing it to elect the NDP and going with supposition and heresay that was almost entirely wrong.” brings up the issue of not only the bloggers content, but also some responders to the site suggesting that if you’re in agreement with the author then you are a socialist, leftie, etc. which is not always the case. Like you, some of us want honesty and ethics to prevail. Like you for some of us it’s not difficult to tell the difference.

Thankyou so much for keeping the light on.

So please Alex help us get rid of this corrupt bunch soon so we can get on with repairing this wonderful province.

Great article, Alex. It reminds me of a Shakespearean quote: “something is rotten in the state of Denmark”. Or, better still, “when the hurlyburly’s done, when the battle’s lost and won, we’ll get Christy”.

Is the MSM outlet the same one that you and I discussed? If so, “what goes around, comes around”.

Mrs. Sparky: Who the hell is Brian Kieran?

Sparky: You remember, he’s one of the Pilothouse guys that was receiving information from Basi and Virk. Now he is cluttering up one of the pages of our Monday Magazine with drivel.

Something is bothering me about his interview on the news a while back where he said he justified his giving Omnitrax classified bidding information because he was worried about being fired.

    Mrs. Sparky: Isn’t that illegal?

Sparky: He said he didn’t see a problem with that.

Mrs Sparky: Geezus! That doesn’t sound right.

I find it VERY interesting that the reason the “Mainstream Media” didnt pursue the Clark allegations that you raised several days before the leadersip election as the story may “influence the leadership result.”
WHAT ever happened to telling the TRUTH?
Let the voters decide . When a story of this importance is not published due to the media being “worried that Clark may win and blacklist us forever” is pure bullshit ! If a politician plays that game then dig deeper. They always have something to hide. Eventually after weeks, months and years of bad press, the voters will get rid of them.

Albeit, I understood the pressure they were under especially Dave because earlier in the week his mother had been diagnosed as having cancer and only he knew about it at that time.

I’m looking forward to seeing Christy crap her Spanx once all the sordid details start coming out. She must be in an absolute manic state today once her buttkissers break the news that all the evidence is likely to be exposed one way or another.

I have to say I admire your restraint and your willingness to protect your sources at all costs. While people were ready to give sainthood to Julian Assange for leaking sensitive documents, he put hundreds of people in serious danger with his wanton carelessness while just wanting to feed his massive ego.

The people have a right to know, but no one should have to put their life in danger for it.

  32. James says:

Alex, I do believe you have slightly understated the magnitude of that which has been perpetrated upon the people of this province and country,

This is not only the greatest SCANDAL in this province’s history but the most DASTARDLY DEED accomplished by elected officials and/or (un)-civil servants in any level of government in Canadian history. I’m afraid that the laundered money trail stretches back far to the east of here and includes some very rich and maybe not so famous persons.

Rest assured that any attack against the bearers of truth (read the likes of one AGT and a very few others) will be met with the wrath the real 99% of hard working Canadians. WE 99% are not to be confused with the mostly wing nut vagabonds squatting in our public squares that our gutless officials elected and non don’t have the fortitude to contend with.

The real 99% of us Canadians have your back. KEEP VIGILANT! But mostly KEEP SAFE! We are all here whenever you need us GUARANTEED. Use those cowboy boats of yours to keep kicking ASS, the rest of us will give them a good shining for you when you’re done.

    Many thanks

Don’t worry pal. Notwithstanding my charmed life…I’ve slept in stairwells most tough guys wouldn’t survive for five minutes. And I’m not at all embarrassed to tell you about it.

It’s the scars in life I want to talk about. Medals are fleeting.

Thanks for the concern. My wife and kids are covered. Me, I don’t worry about me. I’ve seen ugly, front row Relax.

    You are like Batman! :)

I so want the lid blown wide open on this. The people of British Columbia deserve this.

  36. Wake Up BC! says:

    Alex,

Aren’t all such applications for access to government information public?

In other words, can you point us in the direction of any web link which would show which media outlet made the application?

  37. Gary L. says:

Alex, for the last 2 days I’ve been mulling over the endless hours and energy you have logged on behalf of all the HONEST British Columbians, and the best I can come up with is considering the serious ramifications of what and who you have/will outed, PLEASE be very, very careful.
We are all behind you, but we’re “not there”………………… however we are there in our thoughts and wishes.

    Be gentle on yourself, Cheers

AGT, your right, it is time. The courage of one man can change the destiny of the world. You are the man, show us the power of honesty, the truth, the unadulterated facts.

    http://www.youtube.com/watch?v=V6xLYt265ZM&feature=related

Now I ask the rest of you, where is your courage? Will you stand with this man for what is right, what is moral, what is ethical, what is the best part of all of us. Or will you slither silently into the night, confirming that we have indeed become just like the rest of the third world. Corrupt, dishonest, the worst part of our humanity.

It is time to put the criminals in jail, and not public office. Along with all their supporters. Nobody must walk form this, everyone involved must go to jail for a long long time.

White collar crime has killed the economy of British Colombia, time to make these type of financial crimes a capital offense.

And as a side note, the Liberal party of Canada both Federal and provincial should be prosecuted as a organized crime syndicate and their members tossed in jail.

Enough is enough. Crime should not pay regardless if you are a terrorist group masquerading as a religion or a organized crime syndicate pretending to be a political party.

Alex the commentary by Deep Throat is very enlightening. My apologies but I have to ask, is Deep Throat a credible source? Have you talked to this person? He/She seems to have some very critical sensitive information that is clearly relevant to our understanding of what was happening behind the scenes.

    • AGT says:

      In reverse order.

      1) I speak to ‘Deep Throat’ on a regular basis.
      2) ‘Deep Throat’ is extremely, extremely credible.
      3) ‘Deep Throat’ is VERY knowledgeable of the case and is a former friend and supporter of the current Premier.

‘Deep Throat’ is absolutely at the cover-up.

  40. Waiting says:

With all that has been written about Basi-Virk why is it no-one has mentioned the “Fraud on government ‘ section of the criminal code? Section 121? . It is legal to bribe government officials provided permission has been given IN WRITING. Basi-Virk had always maintained their bosses knew about it . Did they have it IN WRITING? would they have been credible? If they had permission but didn’t get it in writing is that a criminal or administrative offence?Government ,business, the media they are all drinking the same kool-aid. Just tired of all the BS

  41. Waiting says:

Did the people who paid the bribes have it in writing? I disagree , it is very relevant . Just like Airbus , certain topics are carefully avoided and smoke screened. However getting back to B-V there was an American company involved wasn’t there? The Americans have been increasing the number of FCPA prosecutions lately. If the Americans blow this case open with their FCPA while we haggle over whether the Auditor General can get info on the lawyers fees Canada will end up looking like the Bannana republic backwater we all fear that we have become

    • AGT says:

I fear you might not understand the way the law works.

Agreements like this are NEVER papered over. And please don’t bring Airbus into this. It doesn’t even compare as there was SOME paper in that case.

There was no paperwork on this–not one bit. At all. As for your contentions about American FCPA cases, that wouldn’t even apply here because and American firm was involved. If Kieran’s testimony was believable their RICO laws would have done the trick long ago.
