‘Basi-Virk’/BC Rail Questions Begin to Mount for Christy Clark
Later today, the court will fully release two search warrants that, until today have been redacted.
Both are search warrants related to apparent benefits received by David Basi and Bob Virk from former Pilothouse PR partners Brian Kieran and (star Crown witness) Erik Bornmann.
The warrants will raise questions about what former Finance Minister Gary Collins knew about the trip to Denver and what role Kieran is alleged to have played. Unfortunately, Mr. Kieran will not face the tough questions from his friends in the media (he is a former columnist) about his role and why special prosecutor Bill Berardino did not lay any charges against him.
Though we’ll raise some here.
But the more interesting warrants which should be released are the ones wherein Christy Clark’s brother Bruce’s bank account records were sought. This was after Erik Bornmann, friend to Christy Clark, then husband Mark Marissen, her brother Bruce Clark and many of her immediate circle of political influence, suggested to the RCMP that Bruce Clark bribed David Basi.
This is a most serious allegation that was NEVER examined or explained.
So, to Christy Clark who told Bill Good this morning that accusations of her involvement in the ‘BC Rail Affair’ “are completely and totally false” and that the whole matter, for her, is “case closed “: That can’t possibly be good enough for an honest public.
She also said that she wants to bring a “more inclusive, better culture” to Victoria. And she wants people to be “more engaged in government.”
Well then, please respond as to why the public should not want you to answer how it is that your brother is accused of bribing a staffer, who was part of a government that you were Deputy Premier of.
Please explain Christy, how it is that during that same period of time, you appear throughout the diary of the man (Erik Bornmann) who claims that one of your then political allies (David Basi) was bribed by your brother.
The fact remains that when Christy Clark tells you that she wants the BC Rail Affair to go away, she’s telling you the truth. Because the questions she’d have to answer are not ones she would ever want to respond to.
When she says she wants a more open government (the same words Gordon Campbell used) THAT’S when she’s lying.
Because if she was prepared to tell the truth–that David Basi and Bobby Virk were pawns in a greater political game, of which she was a part, the self-incrimination would be all-encompassing.
How do I know?
Well, because for the next week I will show you, in writing, how Basi and Virk were used (and abused) by senior government officials including the Premier and how Christy Clark was involved in the possible consolation prize of Roberts Bank going to OmniTRAX.
But all the while, the drive-by media, sorry to say, this morning led by Bill Good, will say (as he did on his program) that he finds “the unfounded accusations in the blogosphere hard to take.”
Okay Bill, then I’ll personally be sending you copies of EVERY post from this week so you can make up your own mind.
Christy Clark cannot become Premier of British Columbia while this cloud hangs over her head. Hopefully, she will either answer the questions or her party will rejected her (which then puts NW in a very difficult journalistic conundrum–how do you take back someone so tainted or biased and expect listeners to forgive?)
More to the point, let’s get started.
Who said the following about the BC Rail deal?
Excerpt One (October 23rd., 2003) :
“Things are further complicated that on the federal side we need to have good relations with people like Bornmann, (Jamie) Elmhirst and Bruce Clark, if we want to get things done…The Minister (Gary Collins) knows about the interconnections between Elmhirst, Bornmann, Christy Clark (EMPHASIS ADDED)…Bruce Clark and the group within the BC Liberals…”
Excerpt Two (November 17th., 2003):
“I spoke to Kelly Reichert, also known as ‘The Senator’ today about BC Rail. He called me twice today to update me on what was happening with (Pat) Kinsella…and the whole cast of characters that seem to pop up in every deal…it was particularly interesting…his thoughts on Kinsella and how closely he seemed to be involved in the deal (BC Rail to CN). The senator gave me information about the tax pools and what was happening regarding this issue from a federal and provincial perspective. He (Reichert) told me that he received this information from Kinsella, who would call Martyn Brown (the Premier’s former Principal Secretary/ Chief of Staff) and the Premier directly if he needed anything. Kinsella would also talk to David McLean, somebody who is connected not only to the Premier and CN but to the PM Chretien himself…the senator said nothing surprised him about Kinsella anymore and his ability to have a finger in every pie (EMPHASIS ADDED).”
I note for the record, that Patrick Kinsella is actively directing Christy Clark’s campaign for the BC Liberal leadership. The appearance of Stew Braddick on Christy’s campaign team two weeks ago is also key, as he is a long-time friend of Kinsella’s wife Brenda and Kinsella himself, who had Braddick also flown in from Toronto during the 2005 Surrey election in futile efforts to rescue Doug McCallum–he was fighting against a then relative unknown name Dianne Watts.
So back to Clark’s contention that the BC Rail case is “closed.”
Major questions about your brother and campaign chieftain (who will play a major role in your Premier’s Office?) remain and you want to turn the other cheek, Christy?
Why?
The questions are mounting and the responsibility is not just to pretend issues don’t exist when they do, but to seek to answer the questions outstanding, so that when you do say you want to bring a different culture to Victoria than the one Gordon Campbell delivered, people will actually have some evidence that you are finally telling the whole truth.
Of course, some of you are wondering where the above excepts came from.
Well, tomorrow, I’ll release that information.
It should be abundantly obvious what’s coming and why Christy Clark cannot, should not, be anywhere near any public office until these matters are thoroughly investigated.
The integrity of the Office of the Premier has suffered enough in ten years.

I missed Christy on the BG show today, but did hear Bill’s utterances to the effect that he finds “the unfounded accusations in the blogosphere hard to take”. And then completely changed the channel. Not even remotely curious. Just change the subject. And he likes to tout himself as fair-minded lol. That BG is part of the Liberal Election Machine, and has been these many long years is as plain as the egg on his face.
[Translate]
All very good, but how about time against (not for) the other candidates, such as Kevin and company? Kevin’s record and that of some of his co-horts isn’t exactly stellar material.
So the other campaigns need to be disected and throughly investigated too, eh?
As with Basi and VIrk, I would also blame them directly, as they kept on with the nonsense, when they could have said “forget it” and clocked out, but they did not.
But this is fascinating reading m’lad.
Keep up and hopefully someone with the power to issue a Summons to Appear will notice.
I would go after DeJOng as to why there was no directive in collecting from Basi or Virk. We have all received Collection Letters, and they have to be resolved. Why not these two characters?
[Translate]
It’s early days yet for the reviews but I will tell you that all candidates, without exception, have some rotten apples in their respective camps.
These questions which Christy must answer are key to the integrity of the office she seeks. If she doesn’t see that then she does not belong in public office.
[Translate]
Very true there, Old Boy. It is early, and I doubt much of anything in excitement will happen over the next week to two weeks being Christmas Season (Christmas, m’lad not “Winterfest”).
Christy does have some “‘splainin to do” , quite a bit, and there’s other aspects aide from Basi Virk. Listened to her on CKNW this morning and she wasn’t all that convincing.
Her position on the HST has to be one of the most stupidest things I’ve seen in in following politics for a very long time.
Some of her supporters and key people aside from Kinsella aren’t exactly First Line matrerial, either. In fact in one case, the supporter should be taken off the ice immediately and given a game misconduct for fighting and high sticking.
[Translate]
Complete agreement. Well put.
[Translate]
This is no doubt some of the best information into the BC Rail fiasco. I’m looking forward to the rest of the story. I especially enjoyed the last part where you point out that Kinsella could just pick up the phone & call his buddies Marty & Gordie.
This is a very different picture than what what Marty (Martyn Brown) painted in court.
” “I don’t recall any awareness of Mr. Kinsella’s role with B.C. Rail at that time. I don’t recall even the issue of him working for CN Rail, let alone B.C. Rail,” Brown said. “I don’t recall being quote ‘lobbied’ by Mr. Kinsella on anything.”
Keep it up Alex
Guy in Victoria
[Translate]
Yes, interesting statement by Martyn Brown to be sure.
[Translate]
What is the punishment for perjury, after the fact (trial being over)?
[Translate]
The same as it would be if someone had perjured themselves then and there.
[Translate]
Jamie Elmherst is actively managing Christy’s campaign. Not that is that surprising mind you. The more I hear about this stuff, the more I am convinced that Christy cannot win the leadership.
[Translate]
Yes, I’m aware of Jamie Elmhirst’s involvement and was going to dissect that tomorrow.
Thx for this.

“`Bill Good, will say (as he did on his program) that he finds “the unfounded accusations in the blogosphere hard to take.””
Will have to wait and see how your evidence unfolds in the next while as to whether Bill Good has a point or not, since there are still many unanswered questions. But isn`t that the point of what is happening in the blogosphere, the fact that reporters like Bill Good are NOT digging for the truth, but rather are screaming foul against a colleague of theirs, who happens to be Christy Clark.
I have to wonder if she and her cohorts had the for vision to realize that if she got a radio gig on CKNW, she would be able to effectively neutralize the mainstream media in this province from asking tough questions of her down the road with respect to BC Rail since she is now one of their own. After all, how on earth can Bill Good, Michael Smyth, and for that matter, CKNW be completely impartial here. I just don`t see how it is possible. As of late, I am beginning to lose respect for CKNW and that is a shame, since this station had been the go to radio station for news in this province.
I’d like to see if Vaughn Palmer turtles on this one as well or if he would have the jam to comment on what is happening in the blogosphere and if he thinks that there is any merit to having the unanswered questions answered. Will Vaughn give people like you and your readers credit, or will he chalk us up to a bunch of nut bars who are looking for something that doesn’t exist.
[Translate]
I assure you the evidence is overwhelming that Christy should not be holding any public office, at least utility she answers the glaring questions about her involvement in the sale of BC Rail.
Much more to come. Stay tuned.
[Translate]
People like Good and Palmer have said they don’t, and won’t, read the blogosphere. Yet they seem to have an idea of what outrageous things are being said. Publicly, they want to paint all online writers the same instead of separating the real ones from the few crackpots.
I wonder if Smyth will have any trouble returning to his desk as a fair and balanced pundit when he is finished being a placeholder for the good Liberal.
[Translate]
Good points. Smyth actually took toth airwaves today to announce that Christy has a BC Rail problem.
Imagine that? It’s finally occurred to Mike!
[Translate]
Interesting reading – keep it coming – as one who could be asked to vote on a new leader for my party I was reluctant to support Christy in the first place and this information supports my view that involvement in BC Rail will drag down the Liberal party attempts to refocus it self and keep the NDP from achieving power.
While off topic – speaking of the NDP – I picked up a rumor at a weekend political event that the real reason that Carole James was forced to resign when she did was because the BC Fed was willing to pay off the Party`s 1Million debt BUT only if she step down immediately – anybody able to confirm this.
[Translate]
Hi 101, yes I’ve heard the same thing and am looking into it.
[Translate]
So…
Let me get this straight …
Erik Bornman accused Bruce Clark (Christy’s sister) of bribing Basi and Virk. For what? To get the government to give the spur line to Washington Marine Group?
If this were true, are you suggesting that the RCMP has done a coverup?
And you’re saying that Erik was a FRIEND of Christy Clarke’s?
And, according to your story telling, Christy was feverishly helping Bornman, who called her brother a briber, to give the consolation prize to Omnitrax (Bornman’s client) instead? Hmmm… Yeah, right.
And Patrick Kinsella, her supporter, was getting the deal for CN, not Omnitrax or Washington Marine Group?
Hmm… Sounds like a criminal conspiracy to me! …. NOT
Weren’t all of these allegations investigated? Are you suggesting that they weren’t? What did the RCMP do over all of these years?
We all know that Erik — the acknowledged briber — cut a deal with the prosecution to testify against Basi and Virk, but no such prosecution deal has ever been suggested about Bruce Clarke.
So, logic would dictate, that, if after seven years and millions of dollars, many of the allegations, such as Erik’s allegation about Bruce Clarke being a briber, are false.
Stop the presses.
“Erik Bornman shouldn’t run for premier” should be your headline.
[Translate]
Anne:
1) Getting it straight means that you first wipe the foam from your lips and take a deep breath to clear your head. In this case, you failed off the bat.
No one mentioned the words “criminal conspiracy”–just you.
2) Bruce Clark (spelled without an ‘e’ at the end) is Christy’s brother, not sister, unless you know something I don’t.
3) Bornmann (spelled with a double ‘n’ at the end) did not accuse Basi or Virk of receiving bribes to grease the skids for Washington Marine. I don’t know why he did that and that’s why I’ve raised the questions I have.
4) No, I’m ont suggesting an RCMP cover-up. Not sure where you got that either.
5) Bornmann was indeed a friend of Clark’s and high-ranking lieutenant in her political organization. This is a well-known fact.
6) I never once wrote that she was “feverishly” helping Bornmann against her brother or that she was meeting with Bornmann for one specific purpose. You have confused (intentionally, I gather) two separate issues for the purpose of supporting Christy. At least that much of what you’ve written is clear.
7) That Mr. Kinsella or Ms. Clark may have been working for what you perceive as competing interests is not the point. It’s that while CN was the preferred bidder, OmniTRAX and the Washington Marine Group would likely receive consolation prizes through the various efforts of and/ Clark or Bornmann.
9) No, not any of these allegations were investigated. Or, more problematically, examined in court. That’s a point you continue to ignore.
10) “We all know that Erik — the acknowledged briber — cut a deal with the prosecution to testify against Basi and Virk, but no such prosecution deal has ever been suggested about Bruce Clarke.” Again, this is yet another case of you having confused two separate issues. Bornmann’s deal has nothing to do with anything Clark may or may not have done. The point is that Chrsity’s brother appears in all sorts of matters related to this deal while she was Deputy Premier. Why was that? Did she have anything to do with that? She’s running to be Premier. Will he figure prominently again?
11) “So, logic would dictate…” Ma’am. Please don’t that phrase ever again. you do it not justice.
In the future, should you wish to come back, try appearing with something that makes sense.
[Translate]
I listened to BG’s interview with Clark today and it nauseated me.
This woman, because of her involvement with NW, gets a free ride from the station. BG lobbed softball questions to her, and one little blurb at the end about BC rail.
Two things stand out:
1. She (Clark) says people’s faith in Gov’t has been shaken.
So tell me Ms. Clark, how does glossing over the BC rail fiasco and not calling an inquiry stabilize our faith in gov’t? Not at all I would say.
2. Clark kept repeating how she, because of her gig at NW, was able to hear the people and came from a different perspective than the other leadership contenders. Talk about whoring out her time at NW and using the station to push forward her agenda/leadership bid. Shamefull.
So Ms. Clark, you say you want a new type of gov.’t, one that is transparent, for the voters. You say you want to resolve the matter of the HST now (quickly), by shutting out the public and putting it back to the MLA’s. Why? To save 30-40 million to use somewhere else.
To that end I have a challenge I would like to issue to Ms. Clark:
That money you say will be saved by nixing the referendum, PUT IT TOWARDS AN INQUIRY INTO THE BC RAIL SCANDAL.
Show us all that you are truly different than the rest; that you want a gov.’t that truly represents the people.
[Translate]
Superb…
[Translate]
Heard the interview with CKNW. The question by Bill Good was reluctantly thrown in at the end but Christy sounded like she hoped she could say, “I can’t comment on that, the matter is before the courts.”
Clearly, this issue is not going away and the search warrants need to be fully disclosed into the affairs of Bruce Clark who happens to be fundraising for Christy.
Christy and her campaign team have direct links to Erik Bornmann and she should completely distance herself from the likes of Bormann et al.
[Translate]
More to the point, she must explain her participation in the sale of BC Rail.
[Translate]
I read the story of the up and coming premier, not yet elected, and if I would be her, I would answer questions truthfully or else back out of her so call commitment to public service.
It is unfortunate that Christie Clark has a brother like Bruce. There seems to always be one in the family, especially bigger families.
I can only presume that Alex is not a buddy of Mr. Bill Goods. I hear he is resigning from CTV. A lawyer, writes about Mr. Good on a blog which ought be linked to Alex’s website: http://gordonlara.blogspot.com/

We do not support gossip websites here. While I have often question Lara Dauphinee’s credentials to be sitting in the Premier’s Office, it’s only where it pertains to her qualifications. What she may be doing with the Premier in her private time is of no concern to me or should be to you. But the question remains: Is she a qualified public servant or is she there because she is a close pal of the Premier’s?
The distinction is very important. But the salaciousness of the allegations on no shortage of other blogs is distasteful.

Bill Good has _never_ been a journalist that would dig for the truth. I wouldn’t give him or C a min of my time. And i am proud to say that i have never listened to them. period. CKNW=sweet Mouthwash.
Mr. Good, I assume from your comments about the blogsphere, that you must read this Blog” Let me inform you that there is a lot of hard-hitting news and truths coming from Blogs. In the old days your big $$ Media stations controlled the flow of information and thus controlled the propaganda. Well listen up… We don’t buy your pablum anymore. You are left with an audience of dim-wits. The hip ones are reading Blogs, online alternate media, etc. …
You Mr Good have been supporting one of the most sleazy political regimes that BC has ever seen. You Mr Good have said diddley-squat about the bc rail fiasco .Where have you been on the sell-out of BC salmon? where have you been on river power scams. You have been a mute on these important issues,
The real news and real stories have been coming from outside the Traditional Media sources… Because the TM for the most part are eunuchs.
You, Mr. Good, have no knowledge of how Blogs work. Or their power.
As for this Blog. We await the evidence that you, AGT< have uncovered, and hope that it will shed light on the issues of the BC Rail scandal.
And I as many others are, get very nervous when a person like Christy Clark talks about wanting a "open-government" because fir the past 15 years politicians say one thing then do the complete opposite.
Campbell ;BC Rails is not for sale! The next year he sells it (999 year lease)
Campbell: No HST for BC. One Month later HST for BC….
So Christy: Wants a more open government (the same words Gordon Campbell used) .. .we all know this is a code word for ; " We'll shut her up tighter than a ship and poke you in the eye when you come asking tough questions."
No CC has to be kicked back to her CKNW job, were I'll never have to see or hear her.

Enjoying the work as usual AT – for one who was out-of-province for the events at the core of BC Rail this is enlightening to say the least… I too missed Christy with Good this AM, but did hear his challenge during the Monday Morning Quarterbacks segment for anyone to present him with one piece of evidence showing Christy Clark was involved in the BC Rail deal…
For me simply being in a high ranking cabinet job constitutes an involvement, and the onus is on her to prove whether the involvement was superficial or deeper… as it should be with all who held key government posts at the time.

Folks, for those of you who don’t know that we are being blessed by broadcasting greatness, the ‘Sean’ who wrote this very pithy comment is none other than Sean Eckford, the news director of CKAY 91.7 FM broadcasting from Nanaimo. He is the older (and not quite as good looking) brother of Michael Eckford, host of Shaw TV’s award-winning ‘Urban Rush’.
The Eckford’s attended St. George’s with me and Sean is one of my classmates.

AGT. I am a new reader. I appreciate the time that you have spent putting your blog together.
But so far you have not brought forward anything to support cause for concern, much less cause for your effusive language thinking something is wrong.
Bruce Clark is Christy’s brother. Not only has he not been found to have done anything wrong, but even more to the point it has not been proven that Christy was any part of any alleged wrong-doing. There are many siblings that behave in a way their more famous sibling do not approve of. (Jimmy Carter’s brother, for one)
Also Patrick Kinsella is a well known political operative. If he was prominent in Gordon Campbell’s office, it is not surprising at all that he is involved in Christy’s campaign.
I think you weaken your credibility with continuing days of innuendo, rather than presenting facts that prove some wrong-doing. So far Bill Good has it exactly right.
I look forward to you presenting some facts to back up your innuendo.
[Translate]
Unfortunately for you, you have cast statements I have made into a bin of your choosing.
1) Bruce Clark has not been charged with a crime. But his conduct is significant WHILE HIS SISTER WAS DEPUTY PREMIER. IF this is something you do not understand, I cannot help you. The issues raised form his alleged conduct in addition to her own during the time prior to the sale are hugely SIGNIFICANT. They are not innuendo. They are fact. Christy met with Bornmann about what? She claims to have been an arm’s length from a deal she was clearly involved in (her meetings with Bornmann, her advice to Virk). These are all contained in court documents. These aren’t made up facts.
2) No one has ever ascertained whether or not Bruce Clark had done anything wrong. The trial was abruptly ended prior to an examination of his conduct according to both Bornmann and Basi.
3) Patrick Kinsella, the former campaign chair of the Liberal 2005 campaign received a no tender contract to vet the BC Rail Deal. He is a close friend of the Premier’s. David McLean, who raised significant money for the BC Liberals during the same campaign is yet another close friend of the Premier’s. A bidder wrote letters complaining that the process was skewed in favour of CN. None of this is innuendo.
4) Bill Good, on this issue, has it exactly wrong. Christy wants to be Premier and it was alleged in court that she was a Cabinet leak. If that’s the case, she is unqualified to be Premier. If that’s not the case, and she will not allow for that information to be examined, then she is also unqualified to be Premier.
On that last point, if she is ducking a review, the obvious question is: Why?
There’s nothing to hide, right?
Lastly, pls don’t concern yourself with my credibility. It’s fully intact.
And as the days pass will only grow exponentially.
[Translate]
Wow, Alex. Missed the obvious question!
Did you ask the courts to release the two warrants??

Yes, it’s all in the works.

That was a good one! Quick! Take a poll of how many readers already had composed in their minds their reply about “where?” missing.
On a bewildered note: Of course this pair are guilty. The judge accepted their guilty plea. After this many years of high-priced lawyers nit-picking through the documentation, and on and on. The only conclusion a rational person could have is – they and only they are guilty.

Palmer splits fines hairs in the last paragraph of his column dated October 23, 2010
“Rather there needs to be an independent assessment. The auditor-general could review all the paper work, interview the players, and render a verdict on whether the decision on the legal bills, however well-intended, struck the right balance in the public interest.”
http://www.vancouversun.com/news/Deal+Basi+Virk+hook+legal+costs+needs+hard+look/3716689/story.html#ixzz183EjFxol
Vaughn Palmer while agreeing that there needs to be an independent assessment of the decisions made by the supposed independent prosecutors, uses terminology such as “well intended“ which seems to suggest that what went down with the improper utilization (in my opinion) of the Financial Act for the purpose of forgiving the debt of $6 million was “in the public interest.”
As Palmer also pointed out in his column of October 28, de Jong took issue with a caller who complained about a “cover up” on the Christy Clark show where de Jong stated, “You are challenging the integrity of the independent special prosecutor.”
Well, all I can say about that is the audacity of the caller. And to think, such questions are asked in a democratic society. What nerve.
Isn’t that the kind of question that should be asked by reporters?
[Translate]
Sure.
But I think people need to start thinking about something else as well.
What were Basi and Virk really paid? If they were paid just their legal fees, that’s bad enough, right? But what if they were paid BEYOND THAT?? Why would the government be settling so large with two men the Premier relishes in saying are “admitted criminals”?
If they are really criminals, why not prosecute them to the full extent of the law?
We’ll be examining that in coming weeks.

Quick correction
My comment on Palmer’s article which included de Jong on the Christy Clark show was from October 23 not 28.

Lest we forget,
“The Vancouver Sun reported that Berardino — appointed special prosecutor in December 2003, days after the raid on the B.C. legislature — donated $500 to Liberal candidate Wally Oppal’s election campaign in May 2005.”
But hey, you better not challenge the integrity of the special prosecutor, Mr. de Jong might take issue with that.
